What Is A Trademark?

A trademark is a word, phrase, symbol, or design that identifies and distinguishes the source of the goods or services of one party from those of others. When using the marks in publications that will be distributed only in the United States, include the appropriate TM, SM, or ® symbol on first use. For publications that will be distributed outside the United States, do not include trademark symbols. Instead use the appropriate trademark attribution notice, for example: System Cleaner is a trademark of Pointstone Software, LLC, registered in the U.S. and other countries.

Why Does Pointstone Software Prohibit Unauthorized Use Of Its Trademarks?

Pointstone Software trademarks represent valuable property rights belonging exclusively to Pointstone Software, LLC. Any unauthorized use of Pointstone Software trademarks by a third party may confuse potential customers as to the source of the goods or services being offered for sale. In addition, unauthorized use of Pointstone Software trademarks may dilute the distinctiveness of Pointstone Software trademarks by diminishing the capacity of Pointstone Software trademarks to identify and distinguish Pointstone Software goods and services from others. Pointstone Software will not permit any use of its trademarks that may create customer confusion or that will tarnish the quality its trademarks have come to represent.

Pointstone Software vigorously protects its trademark rights on an ongoing basis, including searching the Internet for any unauthorized use of its trademarks and taking all necessary steps to terminate such use.
